Is it Against The Law To Play Online Poker in the US?

No.

The major confusion comes from a bill that was passed called the Unlawful Internet Gambling Enforcement Act (UIGEA).

This new piece of legislation was passed by the Bush administration back in 2006 as part of an unrelated port securities bill which many online, US poker poker players consider to of been undemocratically and unjustly passed.

The UIGEA did end up making some of the large poker sites leave the US market but this was mainly due to concerns over the legislation. Online poker players are not doing anything illegal or breaking the law by playing online poker, the law is more targeting payment processors.

There are still some fantastic online poker rooms for US players and still a huge amount of top online poker players coming out of the US that are grinding away on US friendly poker sites.

The UIGEA was passed into law by President George Bush in October, 2006, and makes it illegal for online gambling sites (not just poker sites) to accept funds or wagers from the United States if the underlying gambling activity violates existing federal, state or tribal law.

The law does not make the player liable in any way, but makes the site liable for accepting funds or wagers associated with illegal Internet gambling.

As an online poker player located in the United States, you are not breaking the UIGEA or any other federal law, but you may be violating state or tribal law depending on the laws of the state or Native American Reservation where you reside.

It's the poker player's responsibility to understand the legality of playing online poker under the law where he or she lives.
